Hamiltons Blasting Services and David Hamilton fined and convicted over breaches of WHS Act 

On 17 December 2021 the District Court of New South Wales convicted and fined Hamiltons Blasting Services Pty Ltd (HBS) $300,000 for an offence under section 31 (Category 1) of the Work Health and Safety Act 2011 (the WHS Act) for being reckless to the risk of workplace death or serious injury. This is only the second conviction for a Category 1 offence recorded in New South Wales.

HBS was also convicted and fined $12,000 for failing to notify the Regulator of the incident in accordance with section 15 of the Work Health and Safety (Mines and Petroleum Sites) Act 2013 (the WHSMPS Act) and $12,000 for disturbing the incident scene contrary to section 17 of the WHSMPS Act.

The convictions relate to a shotfiring incident which occurred at Albury Quarry, about 15 kilometres north of Albury, on 10 April 2018 when workers and members of the public were exposed to risks to their health and safety as a result of flyrock being ejected after a blast. The Resources Regulator offices will be closed from 12pm Friday 24 December 2021 and will reopen Monday 10 January 2022. During this time, contact with the Regulator will be limited.

Rear dump truck narrowly avoids collision with light vehicle

The Resources Regulator has released information about a near-miss incident at Maules Creek Coal on 6 December 2021.

At about 2 pm on 6 December, a fully-laden Hitachi narrowly avoided colliding with a light vehicle at an intersection on the mine haul road. The Hitachi’s front right-side wheel missed the light vehicle by less than one metre,  with the two vehicles coming to rest about 1.65 m apart.

Worker suffers serious burns in underground loader fire 

The Resources Regulator has released information about a loader fire at Cadia East Underground Mine on 25 October 2021 that caused serious burns to a worker.

The worker suffered burns to approximately 25% of his body, with severe burns to both hands, the back of an arm and shoulder.

Key compliance priorities for January to June 2022

We have published our Compliance Priorities for January - June 2022 which sets out our key compliance priorities and proactive assessment programs for the next six months. Publishing this document serves to increase transparency, community and industry confidence in our regulatory activities and increase levels of voluntary compliance.

Between January and June 2022 the Regulator aims to complete five compliance priorities targeting onboarding training for new workers, ignition of methane, entanglement around conveyors, rehabilitation reforms, and a review of the quarries sector to ensure compliance with Mining Act authorisations.

Annual Mine Safety Performance Report 2020 - 2021

The latest Mine Safety Performance Overview and Report for 2020 - 2021 is now available.

The report provides a 10-year overview of industry safety performance and regulatory activity data under work health and safety legislation. Reporting this information provides lag indicators of safety performance and enables operators to benchmark their performance against others in their industry sector. A steady decline in overall industry frequency rates for serious injuries, lost time injuries and total recordable injuries has been observed since 2011 - 2012.
