On 1 December 2021 we will be hosting a free, half-day online education and awareness session for explorers on compliance obligations under the Mining Act 1992.

The webinar agenda is now available and includes a summary of the Regulator’s findings from audits and other investigations, native title and exempted area implications, and an opportunity to discuss good practice in compliance management in exploration.

Latest compliance audit program review


We routinely undertake compliance audits of mining operations and exploration activities to assess whether title holders are meeting their compliance requirements and to identify opportunities for improvement.

Our compliance audit strategy and program include a requirement for annual review of the audit programs against the identified objectives. The Compliance Audit Program review report provides a review of the compliance audits undertaken by the Regulator between 1 January 2020 and 30 June 2021.

Prosecution proceedings commenced for alleged breaches of mining laws

We have commenced prosecution proceedings against a 36-year-old man and 65-year-old man, both of Inverell, for alleged breaches of the State’s mining laws.

The proceedings relate to an inspection undertaken by the Regulator on 16 November 2020 at a property on Rickey’s Lane Sapphire (near Inverell) after it was suspected that illegal mining was taking place.

New standard rehabilitation conditions on mining leases 

A letter from the Executive Director Assessment & Systems of Mining, Exploration and Geoscience was recently distributed to all lease holders in regards to the new standard rehabilitation conditions on mining leases. The letter outlines the key requirements of the conditions and provides details regarding the transitional arrangements, such as what mines should be doing to get ready, and what happens to existing mining lease instruments and conditions. A copy of the letter can be viewed here.

To assist industry prepare and transition to the new standard rehabilitation conditions on mining leases, we are offering engagement sessions for lease holders and relevant stakeholders.

This will ensure we have active dialogue with industry about our expectations for compliance and enable us to assist industry with meeting the new requirements.
