We undertake regular reviews of the rehabilitation cost estimate tool to ensure it remains accurate and reflective of third party costs should the security deposit be required in the unlikely event of default by a titleholder. In 2021 we engaged a specialist consultancy firm to undertake a benchmark review of the rehabilitation cost estimate tool. The benchmark review process involved sourcing rates from a range of sources including earthworks contractors, demolition contractors, mine sites and specialist consultants.

As a result of the review, the rehabilitation cost estimate tool has been updated to reflect revisions to specific rates as well as to include new rehabilitation line items. A key outcome being that the number of line items have been increased to 236 from 172 line items listed in the current tool. These additional items have been added to the tool to improve the granularity of calculations and to account for the range of rehabilitation methodologies that may be adopted for various exploration and mining scenarios.

Recognising the need for the industry to prepare for the new requirements under the Mining Regulation 2016, which includes the trigger to submit rehabilitation cost estimates on an annual basis, a transition period is in place until 2 July 2022 to fully comply with the requirements. We are implementing a staged implementation approach whereby all title holders must use the updated rehabilitation cost estimate tool from 2 July 2022. Up until 2 July 2022, industry may choose to use the existing tool  or the revised tool.

Don't forget to upload your spatial data

From 2 July 2022, large mines (mines which have an Environment Protection Licence from the NSW EPA) will be subject to new standard conditions set out in Schedule 8A of the Mining Regulation 2016.
 
To get ready, mines are reminded to upload the required spatial data themes to the Regulator’s Mine Rehabilitation Portal.
 
The Mine Rehabilitation Portal is an Australian first and allows mining companies across the state to submit, analyse and report on their rehabilitation activities in a consistent and streamlined way. The portal also assists the Regulator in monitoring and regulating rehabilitation requirements for mining activities.

Inverell pair convicted and fined for breaching mining laws

On 23 December 2021, Inverell Local Court convicted and fined Robert John Walburn (65 years old) and Jedadiah Blake Walburn (36 years old), both of Inverell, a total of $60,000 each for three offences of mining without authorisation under section 5 of the Mining Act 1992.

The convictions are the result of an inspection conducted by Regulator staff on 16 November 2020 at a property on Rickey’s Lane Sapphire (near Inverell) where it was suspected that illegal mining was taking place.

On sentencing, the court emphasised the seriousness of the offences, the environmental harm caused by the offending and the need for deterring others in undertaking similar activities.

New Executive Director

We are pleased to welcome Peter Day, the new Executive Director of the Resources Regulator. Peter joined the Regulator in January and has extensive experience in regulatory roles.

He joins us from the Department of Primary Industries where he held the role of Director, Biosecurity & Food Safety Compliance and Integrity Systems since July 2019. Before that Peter was Group Director Emergency Operations, Intelligence & Programs and has also spent several years in other NSW government regulatory roles.

Key compliance priorities for January - June 2022 published


In late 2021 we published our Compliance Priorities for January - June 2022 which sets out our key compliance priorities and proactive assessment programs for the next six months. Publishing this document serves to increase transparency, community and industry confidence in our regulatory activities and increase levels of voluntary compliance.

Between January and June 2022, our compliance priorities will include rehabilitation reforms and a review of the quarries sector to ensure compliance with Mining Act authorisations.

Exploration in the Gallery - The Art of Exploration

Tickets are now available for Exploration in the Gallery - The Art of Exploration, to be held on Tuesday 28 June 2022 from 9:00am - 2:00pm at the Art Gallery of New South Wales, Sydney.

Exploration in the Gallery is an annual seminar presented by the Department of Regional NSW's Mining, Exploration & Geoscience and features highlights of recent projects by the Geological Survey of NSW and their implications for exploration, mining, research and investment.

A full program will be available in the coming weeks, however interested parties are invited to register early as tickets are limited.
