Information for industry - New standard conditions
We've just released new information for industry about the new standard conditions that came into effect on 2 July for large mines with an Environment Protection Licence.
We've had feedback from industry about the new conditions and have prepared information to help you with the implementation process.
The NSW Government introduced new standard rehabilitation and reporting conditions on mining leases to set clear, achievable and enforceable requirements for rehabilitation across mine sites in NSW. The changes introduce regulatory tools and set clear requirements for rehabilitation throughout a mine’s life, from the mine design stage through to closure.
We've prepared these Frequently Asked Questions to assist large mines navigate the implementation process.
The Mining Amendment (Standard Conditions of Mining Leases-Rehabilitation) Regulation 2021 started on 2 July 2021. The new conditions apply to all new mining leases granted from that date.
The transitional period for existing large mines ended on 2 July 2022 and the new conditions now apply.
In regards to small mines (those mines that are not subject to environment protection licence under the Protection of the Environment Operations Act 1997), the transitional arrangements for compliance with the new standard conditions continue to apply until 2 July 2023 (24 months from the date the Regulation commenced).

Recording of webinar now available
To support the implementation of the new standard conditions for rehabilitation and the launch of the new online forms, we hosted 3 webinars on 28, 29 and 30 June. The webinars:
- provided an overview of the rehabilitation reforms
- provided the legal and operational context for each of the new online forms, including how they are to be completed in sequence
- provided a demonstration of the Mine Rehabilitation Portal.
