Mr. Ethics - March 2014

Dear Mr. Ethics,

We use AIA contract documents with all our owners and subs.  We always modify the documents to get better terms for us.  For example, we insert a “paid when paid” clause; broader indemnification; and a lien waiver provision.  We never let the owner or sub know we modified the document.  Now one of our younger employees has voiced ethical concerns about not letting the other party know about the changes we make.  What is your opinion?

Very truly yours, Business is Business

FMI Nonresidential Construction Index (NRCI) First Quarter 2014 Results

NRCI Index Q1 = 64.9

Nearly all components of the NRCI are on the rise this quarter as the NRCI bounced back from a drop of 2.9 points in the fourth quarter 2013 to register 64.9 in the first quarter of 2014, the highest mark yet for the NRCI and 6.8 points better than Q1 2013. Looks like most of our panelists woke up on the right side of the economy this quarter. NRCI panelists expect to make more hires again this year. Moreover, our current report and reports from other sources and surveys are beginning to indicate a growing industry challenge to find and hire talented people. The NRCI Index continues to indicate continued slow growth for construction with caution that comes from the history of ups and downs in the past few years. Read the entire report.
