COLUMBUS– Senate Bill 48, sponsored by State Senator
Troy Balderson (R–Zanesville), today cleared the Ohio Senate by a unanimous, bipartisan vote. The legislation aims to expedite the transfer of liquor permits within a municipality in order to lift unnecessary and repetitive regulations on our small businesses.
“As a small business owner myself, I know how time consuming and costly excessive regulation can be for our job creators,” said Balderson. “This is a very simple piece of legislation that cuts significant red tape for both local and chain restaurants.”
A “TREXed” liquor permit is one that has been moved from one area of the state to another for economic development purposes. In order to be accepted in the new municipality, the permit requires several hearings before the city council or other local governing body. Should the TREXed permit need to be transferred again within that new municipality, it requires a restart to the local hearings, whereas a non-TREXed permit could be transferred in the same manner without additional hearings. The legislation corrects this redundancy in Ohio law.
“I learned about this repetitive regulation from a Cambridge, Ohio company in my district, which could have been spared additional burden had this legislation been enacted sooner,” added Balderson.
Senate Bill 48 will now proceed to the Ohio House of Representatives for further consideration.
