Coley Releases Report from Ohio's Joint Committee on Gaming and Wagering

COLUMBUS - State Senator Bill Coley (R-Liberty Township) submitted the annual report for Ohio's Permanent Joint Committee on Gaming and Wagering today, highlighting a review of the state's gaming industry. 

The report addresses various aspects of gaming, including policies on tax free promotional spend and the potential need for a regulatory gaming structure to oversee games like Queen of Hearts, to clarify the rules that retailers must follow for such promotions, and, if the legislature believes that it should be permitted, to clarify whether fantasy sport or daily fantasy sports are permitted as gambling or skill games and what rules should apply to their operation within the State.

Ohio is one of only nine states that do not tax promotional spend. Among the 26 states with legal gaming, eight states tax every dollar of promotional spend and nine others have various limitations. 

"Ohio casinos have enjoyed over $165 million in free promotional spend at the expense of schools and local government," said Coley who chairs the joint committee. "We have concerns about whether the state can continue to justify this preferential treatment.  While the committee does not call for immediate legislation, further consideration on this very generous deduction is certainly warranted."

The Joint Committee on Gaming and Wagering is charged with reviewing the state's current gaming laws, rules and practices and annually submitting a report to the governor and legislature. 

The report also raises concerns about which, if any, regulatory agency should oversee largely unrestricted games such as Queen of Hearts and Daily Fantasy Sports. Four state agencies are directly involved in the regulation of Ohio's gaming industry.

"Consolidation is another area we should consider in order to streamline accountability and improve communication when issues arise," said Coley.
