Doug Deeth, President of FICPI, and other leading FICPI officers will visit India, China, Korea and Japan later this month for meetings with the patent offices of those countries, and to communicate the views of FICPI on a range of current issues that are relevant to the independent IP profession.  As part of these visits, the FICPI delegates will be offering seminars, free of charge, to FICPI members in Mumbai, Delhi, Beijing, Seoul, Osaka and Tokyo.  Details of the times and locations of the seminars are given below.

Drafting patents for infringement, amendment, clarity and inventive step at the EPO & USPTO
“The specification and claims of a patent constitute one of the most difficult legal instruments to draw with accuracy” Topliff v. Topliff (1892)

Drafting an effective patent application involves much more than simply documenting details of the invention and claiming a collection of features that the examiner might regard as new and inventive: The specification must be carefully drafted to ensure it retains entitlement to any priority claimed, contains acceptable fall-back positions in case new prior art emerges, and the interplay between the claims and the applicable law of infringement has to be taken into account to ensure that the patent protects not only what is new and inventive, but also what is commercially profitable.  The FICPI delegation will address all these points from a European and North American perspectives.

Toxic divisionals at the EPO
In recent years the theory has developed in Europe that since a divisional application and its parent application are co-pending applications, one may be used as prior art against the other if their claims have different priority dates.  The EPO’s Enlarged Board of Appeal is considering this matter in the case G1/15 and is expected to make a ruling soon, which will affect the way practitioners draft applications, claim priority and pursue divisional strategies.  European practitioners will discuss this important topic and outline the holdings of the Enlarged Board.

Patent, trademark and design infringements of tomorrow
“Infringements of tomorrow” deals with use of trademarks and industrial designs in the on-line virtual world of social media and gaming and also covers issues surrounding three-dimensional printing as these relate to all forms of IP.
