FICPI Granted Leave to Make Oral Submissions in Landmark Canadian Patent Case
FICPI has been granted leave to present oral submissions in an appeal to the Supreme Court of Canada in AstraZeneca Canada Inc., et al. v. Apotex Inc., et al. Only three (including FICPI) of six interveners have been granted permission to present oral arguments at the hearing of the appeal. FICPI was granted intervener status on 23 August 2016 (see FICPI News of 22 September 2016).
It is hoped that the Supreme Court will settle the ongoing debate regarding the correct standard of patent utility in Canada, and whether the so-called “Promise of the Patent” doctrine, and the ensuing heightened utility requirement, is the proper standard.
FICPI is represented on a pro-bono basis by Julie Desrosiers and Kang Lee of Fasken Martineau LLP and Alain Leclerc of Goudreau Gage Dubuc LLP.

Filing Analytics from Practice Insight

From time to time, as part of my work for the Membership Commission, I have used the Filing Analytics tool from Practice Insight. For example, at the Zurich ExCo meeting in April 2016, I presented a report on membership numbers from leading firms in countries where FICPI has a national section or association. As part of the presentation, I listed the firms who file the most PCT patent applications in each country. To identify those firms, I had used the Filing Analytics tool from Practice Insight.
Many of the delegates later expressed interest in the tool, and I have been encouraged by the Bureau to follow up to see if we could obtain special pricing for our members. I am pleased to report that we have negotiated a two-year FICPI member discount of 30% from Practice Insight’s regular published prices.
The Filing Analytics tool from Practice Insight is a web-based software/database service that provides information from almost 40 countries about patent filings by major companies and major patent attorney/law firms. Practice Insight compiles its data from WIPO, the EPO, and multiple national patent offices.

Not only does Filing Analytics show the number of PCT filings, it also shows information about foreign filings in the subscriber’s country, including which local firm was used for the foreign national filing. With this information, one can see, for example, the number of patent applications being filed in one’s own country by firms and companies from a particular foreign country (as well as one’s own country), and which local firms have been used to file them. One can also see how many cases the receiving firm is sending back to the foreign originating firm. Such information can be used for strategic marketing and business development.
