Vice President of FICPI, Julian Crump, attended the JPAA 3rd Presidents' Meeting in Tokyo on 12 January 2017.  The principal topic for discussion was the need for local representation in the proposed automated ePCT national/regional phase entry system.

FICPI believes that local representatives play a vital role in ensuring that applicants obtain maximal protection for their inventions in each designated state, where differing laws apply, and help guard against inadvertent loss of rights by ensuring that the correct procedures for national phase entry are followed.

As its website states, the World Intellectual Property Organization (WIPO) is the global forum for intellectual property services, policy, information and co-operation.  It conducts policy discussions on the future development of IP through its standing committees and meetings.  One standing committee concerns the “Law of Trademarks, Industrial Designs and Geographical Indications” (SCT).  The work on this SCT can be challenging at times.

The 36th Session of the SCT relating to the "Law of Trademarks, Industrial Designs and Geographical Indications was held between 17-19 October 2016.  The Agenda included the following:
  • Design Law Treaty
  • The Digital Access Service (DAS)
  • Trademarks
  • Domain Names
  • Geographical Indications (GIs)

Turkish FlagThe Industrial Property Law comes into Force in Turkey

In the 1990’s, Turkey was conducting official negotiations with European Union (“EU”) in order to become a member of the Customs Union. Within this framework, Turkey had to adapt its national Intellectual Property (“IP”) law to EU legislation. To that end, Turkey quickly implemented Decree Laws relating to IP rights such as patents, trademarks, industrial designs and geographical indications in 1995. The Legislature preferred Decree Laws as less procedure was required and they could be put into force rapidly. However, they were been converted into law for a considerable time.

Finally, on 10 January 2017, the Industrial Property Law came into force. The law brings all IP rights under a single code. It is the first time that IP Rights have been covered by a single law in Turkey. The main aim of the law is to harmonise the national IP law with international agreements as well as the recent developments in EU IP law, to bypass the annulment decisions of the Constitutional Court, and to make IP provisions clearer and more understandable. It can be said that the Law fulfils its aim. Consequently it brings many novelties in IP area in Turkey.

We have seen a number of important developments in African IP of late.  These include:
  • Growth in the ARIPO trade mark membership to include Gambia, Mozambique and Zambia;
  • A trade mark judicial decision notwithstanding a state of emergency in Ethiopia;
  • New IP legislation in Liberia incorporating all Liberian IP legislation into a single law; 
  • A new IP framework in South Africa and new design legislation in Zambia; and
  • Updates on an import ban and Madrid Protocol in Zimbabwe.
