Case 168
Trademark infringement in Kenya
Off-grid lighting product

The assistance seeker is a social enterprise whose mission is to manufacture and distribute solar light and power products throughout the developing world. In November 2012 after celebrating five years in business the company reached ten million with its solar powered lighting products. Users report that after upgrading to solar lighting they have experienced: improved health, safety, and performance in school, reduced eyestrain, the ability to generate more income, and health clinics and schools can now serve the community at night. The company is a member of the Lighting Africa program sponsored by the International Finance Corporation and the World Bank.

This off-grid lighting enterprise has discovered there is a solar lantern being sold in Kenya that is infringing on their trademark. Assistance in needed to combat the trademark infringement.

The subject matter is beneficial to the public interest in promoting access to healthy and reliable off-grid lighting in developing countries.
PIIPA is a global nonprofit resource for public interest organizations in developing countries seeking expertise in intellectual property matters to promote health, agriculture, biodiversity, science, culture, and the environment.
