Legal battle for inheritance of house hinges on 1925 law after couple found dead from hypothermia

The High Court has been asked to in­tervene in a £300,000 inheritance row between step-siblings over which par­ent died first. The children of an elderly couple who were found dead at their home have to determine who died first in or­der to receive the full inheritance, thanks to an almost century-old law.
John and Ann Scarle - who each had children from previous marriages -were both found dead from hypother­mia after police were called by worried neighbours to their home in Leigh-on-Sea, Essex, in October 2016. Police be­lieve there was no foul play and ruled out suspicious circumstances.
Now, in a battle centred around the Law of Property Act 1925, their children are at war over which of them should inherit the house.
The family of whichever of the cou­ple died last should get the £280,000 house, and their step-siblings nothing, the High Court heard.
The law has been used sparingly over the last century, with the last ma­jor cases in 1963, 1958 and during the 1940 Blitz when it was used to settle a dispute after a family of four were killed by a bomb.
In that instance, it was determined that the youngest died last, and the will was left to their estate.
John Scarle's daughter, Anna Winter, insists that her stepmother probably died first, so her father briefly inher­ited his wife's share of the house, then passed it to his daughter when he died. However, Deborah Cutler, Ann's daughter, claims the order of deaths cannot be determined and that the "le­gal presumption" is that her stepfather, who was older, died first, so she and her brother, Andre Farley, should get the house.
Mrs Winter's lawyer, Amrik Wahiwala, said that "on the balance of prob­abilities" it was Mrs Scarle who died first as the state of her body when po­lice found the couple suggested she had been dead longest. Mr Weale argued that even if it could be shown that Mrs Scarle "probably" died first, that is not enough to enable Mr Scarle's family to inherit.
Mrs Winter would have to show that it is "beyond reasonable doubt" that Mrs Scarle died first in order to inherit, he said.
Known as the "Commorientes Rule", meaning "simultaneous deaths", Sec­tion 184 of the 1925 Act states that if two or more people die in circumstances where it is not possible to determine who died first, the younger is deemed to survive the elder, says Stuart Downey, of TWM Solicitors.
"It can lead to completely unin­tended consequences if assets are jointly owned, an individual dies with­out a will or their will is not prepared properly," he added.
The judge has reserved his ruling on the case to a later date.
